The government is seeking to overturn Martini’s rulings excluding certain evidence from a retrial of charges that Bergrin orchestrated the 2004 murder of an FBI informant by members of a violent Newark drug gang.
Prosecutors also are attacking Martini’s decision to move forward with a second trial next week on charges focusing just on Bergrin’s alleged cocaine-trafficking activities, including charges that he plotted to hire a Chicago hit man in 2008 to silence a witness against another drug client.
The government contends Martini overstepped his judicial discretion by breaking up the 33-count indictment and forcing prosecutors to try the case in separate trials to avoid what the judge feared would be unfair prejudice. The remaining charges, alleging several racketeering conspiracies, murder, witness tampering, prostitution and tax evasion, could be tried at a later date, Martini has said.

Taxi driver Gurmeet Singh, charged in rape, says he picked up hookers, record shows
A taxi driver charged with raping a passenger blamed the DNA match that nailed him on back-seat hanky panky with prostitutes, court papers revealed. “I did not rape anybody,” Gurmeet Singh, 40, told police, according to the criminal complaint. “Sometimes I pick up women, call girls, off the street and have sex with them.” His statements were made public when the married father of two was arraigned in Brooklyn Criminal Court Wednesday morning. The case of Bruce Gordon, who has been charged with Endangering the Welfare of a Child, has been turned over to Bergen County Prosecutor’s Office. Gordon, the former director of Building, Grounds and Maintenance for the Upper Saddle River School District, was arrested on Dec. 19 after school officials discovered child pornography on a computer assigned to him.
