While we find no flaw in the standards employed by the District Court to determine whether alternative sites proffered by a municipality are available, we conclude that the constitutionality of a zoning ordinance must be evaluated according to the alternative sites it leaves open at the time it is challenged, and not only at the time it is passed. We therefore VACATE the District Court’s decision and REMAND for further proceedings consistent with this opinion.
1. Chapter 322-3 of the Town’s zoning code identifies “adult entertainment” as:
A public or private establishment which presents topless dancers, strippers, male or female impersonators, exotic dancers or other similar entertainments and which establishment is customarily not open to the public generally and excludes any minor by reason of age. This includes adult massage parlors, peep shows and adult theaters and similar types of businesses.

Factbox: Key facts about NY Lieutenant Gov Richard Ravitch
NEW YORK (Reuters) – New York Lieutenant Governor Richard Ravitch on Wednesday unveiled his plan to solve the state’s fiscal crisis and close a five-year $60 billion structural deficit.
Ravitch has been in the spotlight increasingly because of speculation that Governor David Paterson might step down. Paterson is currently embroiled in state and federal probes into whether he tried to quash a domestic violence charge against an aide, selected an Aqueduct slots machine vendor to help a political ally, or unlawfully accepted World Series baseball tickets.
Some facts about Ravitch, 76, a long-time financial guru and public servant:
* July 2009 – Paterson appointed Ravitch as lieutenant governor. Paterson, who had been lieutenant governor, became governor in 2008 after Democrat Eliot Spitzer resigned amid a prostitution scandal.

Arrozco sold crack to an undercover officer yesterday and was arrested at approximately 1 p.m., police said. Police received consent to search her 70th Street residence and confiscated $2,000 in cash and a small amount of crack cocaine, said reports.
She is charged with possession of crack, distribution of crack, distribution of crack within 1,000 feet of a school and distribution within 500 feet of public housing.
“If you sell drugs in West New York, you’re going to get caught,” said Police Director Albert L. Bringa, who says his department will be just as aggressive with local drug dealers as with prostitution rings.
West New York police arrested Jean Chatelier, of Sparta, on Friday and charged him with selling drugs out of his car. Police have also conducted nine sting operations and arrested 26 people on prostitution charges since Dec. 31.

And yet, there was this confession earlier this week to a California radio station: “I am gay. Those are the words that have been so difficult for me for so long. But I am gay. But it is something that is personal and … I felt with my heart that being gay didn’t affect — wouldn’t affect — how I did my job.”
Nonetheless, in terms of national political implications, it’s not California, but the state of New York that’s earned its place in the political Hall of Shame in recent weeks.
In addition to Rangel’s and Massa’s troubles, Gov. David Paterson has become involved in a number of scandals encompassing corruption, obstruction of justice and perjury.
Paterson has been facing calls for his resignation ever since news emerged that one of his aides was involved in a domestic violence incident and that state police later pressured the alleged female victim to keep her mouth shut. Four Paterson officials have resigned in the wake of the revelations.
Paterson himself succeeded Eliot Spitzer, who resigned when his involvement in a prostitution ring was revealed.

Rangel acknowledged he became a political liability when he stepped aside from his chairmanship. He said staying on would have prolonged distractions for House Speaker Nancy Pelosi and other Democrats.
“It’s not fair to her and it’s not fair to the many freshmen and those who have close districts, that instead of getting their message out, (reporters and constituents) are asking about me,” Rangel said.
If Massa and Rangel were the Democrats’ only problems, the party might be able to control the damage more easily.
But they also must contend with investigations and misconduct of others in the party:
_Former Illinois Gov. Rod Blagojevich is charged with corruption related to his efforts to fill President Barack Obama’s former Senate seat.
_New York Gov. David Paterson faces two misconduct investigations and increasing calls for him to quit.
_Paterson’s predecessor, Eliot Spitzer, resigned in a prostitution scandal.

The Interlocutor introduces the classic minstrel show figures of Mr. Bones (Colman Domingo) and Mr. Tambo (Forrest McClendon), though the sassy thrust-and-parry associated with those archetypes is used only fitfully. Their chief job is to portray, with villainous leers, an assortment of corrupt white authority figures (lawyers, judges, guards). Even the boys’ eventual champion, the New York lawyer Samuel Leibowitz (Mr. McClendon), is also their callous exploiter.
In contrast the boys themselves are a fresh-faced lot, decent lads just out for a lark, riding the rails when they fall into horrendous trouble. (Their opening song is a gentle variation on all those wistful American hymns to train travel of the first half of the 20th century.) A rail-side fight among hobos in Scottsboro, Ala., brings the police, who discover two stowaway prostitutes, who in turn falsely accuse the nine youths of raping them. What follows are vignettes portraying the title characters’ trials and incarcerations, sometimes on death row.

The Brooklyn judge said ACORN was punished by Congress without the enactment of administrative processes to decide if money had been handled inappropriately. She said the harm to ACORN’s reputation continues because the government never rescinded its advice to withhold funding after it was distributed to “hundreds, if not thousands, of recipients.”
ACORN, or the Association of Community Organizations for Reform Now, describes itself as an advocate for low-income and minority home buyers and residents.
Critics of the group say it has engaged in voter registration fraud and embezzlement and has violated the tax-exempt status of some of its affiliates by engaging in partisan political activities.
Last year, a series of videos filmed at ACORN offices around the country sparked a national scandal and helped drive the organization to near ruin. In one video, ACORN employees were shown apparently advising a couple posing as a prostitute and her boyfriend to lie about her profession and launder her earnings; Brooklyn prosecutors said they did not commit a crime.

Ted’s readers figured out the pieces of the “Blind Vice” puzzle article and deduced that the reference to “Stitching up Kate Beckinsale’s dress in the ladies room” was referring to “Lloyd Boy-Toyed”/Baldwin’s date Renee Zellweger not to “Toothy Tile”’s date because Gyllenhaal’s usual “standard chick” Reese Witherspoon did not attend that show.
It was widely reported at the time that Zellweger was the person who helped stitch-up Kate Beckinsale’s dress in the women’s bathroom at that event, and Baldwin was her date to the Golden Globes; hence Baldwin is “Lloyd Boy-Toyed.”
